Fact of the matter is he is contributing to the site, and a lot of people like his work.

You said it best yourself in a previous thread. Whether or not his theme is original is irrelevant. It is still a theme created (or modified, whichever have you) by him that he voluntarily released to Consolespot. He didn't have to. But as you said, "this site is dedicated to themes." They don't have to be ground breaking.
