I know that it says 4.0 or newer wii only BUT sometime you MUST to do this even on an older firmware to get the Cios to install.
I do not know why? Do not ask!
Well figured out what to do. I found a fix to my problem. google, 4.0nociosfix.rar. this will bring you one site where you can dl this fix. Be sure to follow these instructions. First you must have homebrew installed. Next either backup your current SD card or have another with nothing on it. Load the folders and just the way they are in the archive. Next start homebrew channel, load the top option, follow the install, (You do not need to install the DVDX as you should have already done this when installing the homebrew channel. after the install, restart and choose the second option, wad manager. Load both wad's don't worry if the CIOS35.wad fails just means it's already installed. After this you can reboot then shut off the wii, take out the SD card and copy any apps from your original to the apps folder on the new card, if you have neo-gamma backup launcher you can now run backups, imports and wii iso.
